Terms of Service

1. Acceptance of Terms

By accessing or using PentestOps ("Service"), a product of Extranet Systems Pty Ltd ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Services Description

PentestOps provides:

• Automated Penetration Testing: External and internal security assessments
• Vulnerability Scanning: Detection and analysis of security vulnerabilities
• Compliance Mapping: Mapping findings to regulatory frameworks
• AI-Powered Analysis: Intelligent vulnerability prioritisation and remediation guidance
• Reporting: Comprehensive security assessment reports
• Remote Agents: Internal network testing capabilities

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to users.

3. Authorisation Requirements

By using our Service, you represent and warrant that:

1. You are the owner of the target systems, OR
2. You have obtained written authorisation from the system owner
3. You have the legal authority to authorise security testing
4. The testing complies with all applicable laws and regulations
5. You have signed and submitted a valid Rules of Engagement (RoE) document

Prohibited Activities: You may NOT use our Service to scan, test, or assess any systems without proper authorisation, including but not limited to:

• Systems owned by third parties without written consent
• Government or military systems (unless explicitly authorised)
• Critical infrastructure without proper authorisation channels
• Systems for the purpose of causing harm or disruption

4. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Scan systems without proper authorisation
• Attempt to exploit vulnerabilities for malicious purposes
• Use scan results to harm, extort, or blackmail any party
• Resell, sublicense, or redistribute the Service without authorisation
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity of our systems
• Attempt to gain unauthorised access to our infrastructure
• Use the Service to generate false or misleading security reports
• Violate the rights of others, including privacy and intellectual property

5. Account Terms

5.1 Account Creation

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised access
• One person or entity may not maintain multiple free accounts

5.2 Account Responsibilities

• You are responsible for all activities under your account
• You must keep your password secure and confidential
• You must not share your account credentials with others
• You must enable MFA for accounts with administrative privileges

6. Free Trial

New customers may start a 7-day free trial of the Service. No charge for 7 days - a card is required to start your trial and is only charged after the trial ends, unless you cancel first.

• Starting the trial: You must provide a valid payment card to begin your trial. The card is held on file and is not charged while the trial is active.
• At the end of the trial: Unless you cancel before the trial ends, your selected plan begins automatically and the card on file is charged for the first billing period.
• How to cancel: You may cancel at any time before the trial ends from your account billing settings, or by contacting support@pentestops.ai. If you cancel before the trial ends, you will not be charged.
• One trial per customer: The free trial is available once per person or organisation. We may decline to offer a trial where one has already been used.

7. Payments & Billing

7.1 Subscription Plans

Paid features require a subscription. Subscriptions are billed in advance on a monthly or annual basis depending on your selected plan.

7.2 Payment Terms

• All fees are quoted in USD unless otherwise specified
• Payments are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failed payments may result in service suspension

7.3 Refunds

New customers can evaluate the Service at no charge through the 7-day free trial described in Section 6, and may cancel before the trial ends to avoid any charge. Once a paid billing period has begun, payments are non-refundable except as required by law. Refunds are not available for renewals or upgrades.

8. Intellectual Property

8.1 Our Property

The Service, including all content, features, and functionality, is owned by Extranet Systems Pty Ltd and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Data

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

8.3 Scan Results

Scan results and reports generated through the Service are yours to use for legitimate business purposes. You may share reports with authorised parties but may not use them to misrepresent security status.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We do not guarantee the detection of all vulnerabilities
• We are not liable for damages arising from your use of the Service
• Our total liability shall not exceed the amount paid in the past 12 months
• We are not liable for any indirect, incidental, or consequential damages

10. Indemnification

You agree to indemnify, defend, and hold harmless Extranet Systems Pty Ltd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any unauthorised scanning or testing activities
• Any false representations made by you

11. Termination

11.1 By You

You may terminate your account at any time by contacting support. Upon termination, your access will be revoked and your data will be handled according to our Privacy Policy.

11.2 By Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We detect unauthorised or illegal activities
• Your account poses a security risk

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your data according to our data retention policies.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New South Wales, Australia, and you consent to the exclusive jurisdiction of such courts.
